Rights to Free Consent and Opt-Out

Consent should always be freely given and individuals should be able to withdraw their consent at any time.

Where consent is not required or appropriate, the right to opt-out helps protect your rights, freedoms and interests.

GDPR

• Article 7 defines ‘consent’ as “any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her”.

• Article 7 provides the rules for consent and withdrawing consent

• Article 6 provides the list of legal bases upon which data collection and use may be deem as appropriate.

• Article 21 provides the right to object to direct marketing (including profiling for direct marketing) and the right to object to processing not based on consent or contract, nor mandated by law.
